Terms of Service
Welcome to Nefer.
These Terms of Service (“Terms”) govern your use of the Nefer mobile application and website at nefer.life (the “Service”).
Nefer is operated by GoodRoots Ventures LLC, a California limited liability company (“Company,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms.
1. Nature of the Service
Nefer is a habit tracking application. It lets you create habits, schedule them, check them off, and review your progress. Nefer uses artificial intelligence to help convert your described routine into habits during onboarding and to generate weekly summaries and insights based on your own tracked data.
Nefer is:
- A habit tracking and routine organization tool
- A personal productivity aid
Nefer is NOT:
- Medical advice or a medical device
- Treatment, therapy, or management of ADHD or any other condition
- Mental health care, diagnosis, or counseling
- Crisis counseling
- Professional coaching, legal, or financial advice
Nefer is marketed to adults who identify with ADHD, but using Nefer does not require, imply, or establish any diagnosis, and Nefer does not provide healthcare of any kind. The Service does not replace licensed professionals.
If you are experiencing emotional distress, suicidal thoughts, self-harm ideation, or a mental health crisis, do not rely on Nefer. Seek immediate professional help. In the United States, call or text 988 for the Suicide & Crisis Lifeline. Outside the United States, contact local emergency services.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian permission. The Service is not intended for children under 13.
3. AI Limitations & Assumption of Risk
You acknowledge and agree:
- Routines suggested during onboarding and weekly insights are generated by artificial intelligence.
- AI-generated content may be inaccurate, incomplete, or inappropriate for your circumstances.
- Insights are reflective observations about your own tracked data, not professional guidance.
- You are solely responsible for the habits you choose to adopt and how you act on any AI-generated suggestion.
You agree not to rely on the Service for decisions involving personal safety, medical or mental health treatment, medication management decisions, financial investment, or legal matters. Tracking a habit in Nefer (for example, a medication reminder you create) is a personal organizational aid only; it is not medical advice, and we are not responsible for missed, incorrect, or misinterpreted reminders.
4. User Responsibilities
You agree not to:
- Submit unlawful, abusive, violent, or harmful content
- Use the Service to promote self-harm or harm to others
- Attempt to exploit, reverse engineer, or manipulate the Service
- Use automated systems to extract content or abuse AI features
We may suspend or terminate accounts for violations.
5. Accounts, Subscriptions & Free Tier
You are responsible for maintaining the security of your account.
We offer:
- A free trial on paid plans (currently 7 days on monthly and 1 month on annual, subject to change)
- Paid subscription plans (“Nefer Pro”)
- A free tier
Subscriptions:
- Automatically renew until cancelled
- Must be purchased and managed through the Apple App Store or Google Play
- Follow the billing, cancellation, and refund policies of the respective platform
We do not control the billing policies of Apple or Google.
If your trial or subscription ends without renewal, your account moves to the free tier: your existing habits and history remain stored and accessible, but certain features (such as adding or editing habits and Pro features) are unavailable unless you subscribe. We may modify the features included in the free tier or paid plans over time.
6. User Content
You retain ownership of content you submit (such as habit names and onboarding descriptions of your routine).
By submitting content, you grant us a limited license to process, store, display, and transmit it as required to operate the Service.
Voice and text input provided during onboarding is processed transiently to generate your routine and is not permanently stored.
You represent that you have the right to submit the content.
7. Intellectual Property
All app software, design, branding, architecture, and content structure are owned by GoodRoots Ventures LLC. The Nefer name, mark, and visual identity are our property.
You may not copy, reverse engineer, distribute, commercially exploit, or modify the Service without written permission.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
We make no warranties, express or implied, including accuracy, reliability, fitness for a particular purpose, non-infringement, or availability. We do not guarantee uninterrupted access, and we do not guarantee that reminders or notifications will be delivered by your device or platform.
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, consequential, or punitive damages.
- We are not liable for harm resulting from reliance on AI-generated routines or insights, or from missed or undelivered reminders.
- Our total liability shall not exceed the greater of the amount you paid in the last 12 months or $100 USD.
10. Indemnification
You agree to indemnify and hold harmless GoodRoots Ventures LLC from claims, damages, or legal costs arising from your misuse of the Service, your violation of these Terms, or your submitted content.
11. Mandatory Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY.
A. Binding Arbitration
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration, rather than in court, except where prohibited by law. Arbitration will be administered under the rules of the American Arbitration Association (AAA). The arbitration will take place in California unless otherwise required by law.
B. No Class Actions
You agree that disputes will be resolved on an individual basis. You waive any right to participate in a class action, serve as a class representative, or join claims with other users.
C. Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to info@nefer.life within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in California courts.
12. Governing Law
These Terms are governed by the laws of the State of California. If arbitration does not apply, disputes shall be resolved in California state or federal courts.
13. Changes to Terms
We may update these Terms periodically. The most current version will be posted at nefer.life/terms. Continued use constitutes acceptance of updated Terms.
14. Safety Policy
A. Prohibited Use
You agree not to use Nefer’s input features to promote, plan, or encourage self-harm or harm to others, engage in illegal activity, or attempt to generate harmful content through AI features. We reserve the right to decline to process inputs that violate these rules.
B. Not a Crisis Service
Nefer is not a crisis hotline, emergency service, or monitoring service. We do not actively monitor user content in real time and are not responsible for failing to detect risk signals in content you submit. If you express or experience thoughts of self-harm or imminent danger, seek immediate professional help (in the US, call or text 988).
C. Right to Restrict or Terminate
We reserve the right to suspend or terminate access, without prior notice, if you submit prohibited content, attempt to bypass safeguards, or use the Service in a manner that creates risk to yourself or others.
